These terms govern your use of Elion AI, an AI voice agent platform that handles phone calls, captures leads, and books appointments on behalf of your business. Please read them carefully.
01Acceptance of Terms
By creating an account or using Elion AI ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these terms. If you do not agree, do not use the Service.
We may update these terms from time to time. Material changes will be communicated by email or through an in-product notice at least 14 days before they take effect.
02Description of Services
Elion AI provides AI-powered voice agents that answer inbound and outbound phone calls on behalf of your business. The Service includes:
- Call handling: answering inbound calls 24/7 in natural conversation.
- Appointment booking: scheduling and rescheduling on connected calendars.
- Lead capture: collecting caller details and intent, then delivering them to your CRM or inbox.
- Call transcripts and summaries: structured records of every conversation.
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation and may modify, suspend, or discontinue features with reasonable notice.
03No Guarantee of Accuracy
Elion AI uses large language models, speech-to-text, and text-to-speech systems. These systems can make mistakes — including misunderstanding a caller, transcribing names or numbers incorrectly, booking the wrong time, or generating responses that are not factually accurate.
You are responsible for reviewing critical outputs (such as appointments, quoted prices, and lead details) before relying on them. Elion AI is a productivity tool, not a substitute for human judgment in high-stakes decisions (medical, legal, financial, or safety-related advice).
04Call Recordings and Transcripts
To deliver the Service, Elion AI records, transcribes, and stores phone calls handled by your agent. Recordings and transcripts are stored against your account and are accessible to you through the dashboard.
You are responsible for complying with the call recording laws that apply to your jurisdiction and to the locations of the people you call. In two-party-consent regions, you must ensure callers are informed that the call is being recorded — typically through your agent's opening greeting. We provide consent prompt templates, but final responsibility for lawful use rests with you.
We do not use recordings or transcripts to train shared AI models, and we do not sell this data. See the Privacy Policy for details on storage and retention.
05Acceptable Use
You agree to use Elion AI only for lawful business purposes. You must not, and must not permit anyone using your account to:
- Place calls or send messages that violate telemarketing laws (including TCPA, GDPR/ePrivacy, or local equivalents).
- Use the Service for unsolicited bulk calling, robocalling, or spam.
- Impersonate another person or business, or misrepresent the AI as a human when directly asked.
- Use the Service for fraud, scams, harassment, threats, or any illegal activity.
- Attempt to reverse-engineer, scrape, or interfere with the Service or its underlying providers.
- Use the Service to handle calls subject to regulations we do not support (e.g., emergency 911 dispatch, regulated financial advice).
Violations may result in immediate suspension. We cooperate with carriers and law enforcement on confirmed abuse.
06Payment and Subscription
Elion AI is offered on a subscription basis. New accounts may include a free trial; after the trial ends, a paid plan is required to keep your agent active. Plans, pricing, and included call minutes are listed on our pricing page.
- Billing cycle: subscriptions are billed monthly or annually in advance via our payment processor (Stripe). By subscribing, you authorize recurring charges to your payment method.
- Usage charges: calls beyond your plan's included minutes are billed at the per-minute rate listed on your plan.
- Price changes: we may change pricing with at least 30 days' notice. Changes apply to your next billing cycle.
- Refunds: fees are non-refundable except where required by law. Annual plans may be cancelled at any time, but no prorated refunds are issued.
- Failed payments: if a payment fails, we will retry and notify you. Repeated failures may result in suspension or termination of the account.
- Taxes: prices exclude applicable taxes (VAT, GST, sales tax). You are responsible for any tax owed on your subscription.
07Your Data
You retain ownership of all data you and your callers provide through the Service, including business information, call recordings, transcripts, and lead data. You grant Elion AI a limited, non-exclusive license to process this data solely to operate and improve the Service for you.
We will not use your data to train shared AI models, sell it to third parties, or share it for advertising. See the Privacy Policy for full details.
08Limitation of Liability
To the maximum extent permitted by law, Elion AI and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising from your use of the Service.
Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD 100.
Elion AI is not liable for missed calls, mis-bookings, hallucinated information, or downtime caused by upstream providers (telephony, AI model providers, or cloud infrastructure). You are responsible for ensuring critical workflows have appropriate human oversight.
09Termination and Account Suspension
You may cancel your subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period; the agent remains active until then.
We may suspend or terminate your account, with or without notice, if:
- you breach these terms or the Acceptable Use Policy;
- your payment method fails repeatedly and is not updated;
- we are required to do so by law, by a carrier, or by a third-party provider;
- your usage poses a security or fraud risk to us or other users.
Upon termination, your right to use the Service ends immediately. We retain your data for 30 days after termination so you can export it, then delete it from active systems. Backups are purged on a rolling 90-day schedule.
